Notice of Town Office Closure for the Martin Luther King Jr. Holiday

Town Council Meeting – January 17th

Town Council Vice President John Flores opened last night’s Town Council Meeting. Vice President Flores then announced that Agenda Item 2019-042 Amending Chapter 240, Article III, of the Zoning Ordinances to expand the highway Business District was being moved to the February 7, 2019 Town Council meeting.  Town Councilor Debra Dagwan was invited to offer the moment of silence in honor of Allan Goddard – a lifelong Barnstable resident who served on the Greater Hyannis Civic Association for over 30 years.  This was followed by public comment. Town Council President James Crocker then moved that Agenda Item 2019-075 Appropriation and Transfer Order in the amount of $250,000.00 for Community Housing Creation by Friends Or Relatives With Autism Related Disabilities, Inc. (FORWARD) at 131 Hokum Rock Road, Dennis, MA be referred to a Public Hearing on February 7, 2019 was approved.  Town Manager Mark Ells provided updates on the following items for the period of January 4-17, 2019 during Town Manager Communications:

1.       We are proceeding with the tasks in the budget action calendar for FY 2020 as scheduled.  We are planning to hold a public hearing at 10:00 AM on February 12th for any proposed Fiscal Year 2020 fee changes.  For information on our fiscal year budgets please view the town’s Open Budget website at http://budget.townofbarnstable.us.

2.       We had a progress meeting on January 7, 2019 with Fish & Wildlife to discuss the future potential to siting water supply wells on the 250 acre parcel owned by the Commonwealth that directly abuts the Hyannis public water supply.  The Town desires to continue working with Mass Fish & Wildlife to finalize an agreement that would enable the Town to install public water supply wells on the 250-acre Hyannis Ponds Wildlife Management Area (WMA).  We plan to submit our recommended proposed public water supply well locations tomorrow.  Subsequently, a meeting will be scheduled to review and proceed toward the signing of an agreement by March 31, 2019, describing the conditions for the investigation of said well sites and possible use of WMA for water supply wells.  We will keep you advised of our progress on this important effort.

3.       Mr. Ells reported last meeting that the Massachusetts Department of Environmental Protection had scheduled a meeting on January 16, 2019 in response to a petition from the Conservation Law Foundation and Toxics Action Center.  DPW Director Santos gave oral testimony at a DEP hearing in Boston on a petition by the Conservation Law Foundation requesting the DEP establish drinking water standards for PFAS’s and to immediately adopt a Health Advisory level for PFAS’s at 20 parts per trillion.  The current advisory level is 70 parts per trillion.  Adopting a 20 parts per trillion standard would have a significant impact on the Hyannis Water System.  Director Santos testified that the State should proceed under their current system of evaluating new maximum contaminant levels on the basis of public health studies, cost/benefits, available treatment technologies, and sampling protocols.  He further pointed out that DEP needs consistent policies and procedures regarding how sources of contamination are regulated and enforced to support its review of PFAS drinking water standards. https://www.mass.gov/lists/petition-for-rulemaking-to-establish-a-treatment-technique-drinking-water-standard-for-pfas.  Testimony was taken under advisement by DEP.  We will keep you advised as more information becomes available.

4.       On November 27, 2018 at 3:00 PM, Mr. Ells attended the Board of Health (BOH) to further discuss the proposal to eliminate or modify Chapter 360 Article XV. Protection of Saltwater Estuaries Interim regulations.  The hearing was continued to January 22, 2019.  Mr. Ells provided an overview to the Land Acquisition and Preservation Committee on Monday and the video of this overview is available for review on our website. We will keep you advised of our progress on this matter.

5.       The Town’s cable license with Comcast of Massachusetts, Inc. expires December 31, 2019.  As part of the renegotiation process, the Town has retained outside counsel who represents a number of communities statewide on cable-related issues. Legal Counsel initiated a license compliance review and began meeting with Cable Advisory Committee Chair Nancy Richards and town staff including Finance Director Mark Milne, IT Director Dan Wood, Community Services Director Lynne Poyant, Town Attorney Ruth Weil and Barnstable Public Schools Facility Director David Kanyock.  Discussions have also occurred with Terry Duenas, Executive Director, Cape Cod Media Center.  The internal working group identified above is scheduled to meet with Comcast again on January 29th, 2019 to discuss specific terms to be included in the renewed license.

6.       On January 10, 2019 Mr. Ells received a memo from the Superintendent of Schools informing him of the School Committee actions relevant to the Waldorf School property in Cotuit.  This was exercising a condition within the lease – the decision at the end of the term of the lease to not renew the lease.

President Crocker then referred Agenda Item 2019-083 Appropriation order in the amount of $147,725.00 Community Preservation Funds for preservation and restoration of Saint Mary’s Episcopal Church, 3055 Main Street (Route 6A), Barnstable, MA to a Public Hearing on February 7, 2019 which was approved.   Town Manager Ells introduced Ryan Castle, CEO, Cape and Islands Association of Realtors (Property Owners’ Obligations); Mark Milne, Director of Finance (Summary of Key Points of Act Affecting Municipalities and Municipal Actions); and Elizabeth Jenkins, Director of Planning and Development: (Local Regulatory Considerations) as it relates to Chapter 337 of the Acts of 2018-An Act Regulating and Insuring Short-Term Rentals.  

During Council Communications Councilor Paul Hebert mentioned that the Cape Cod Regional Technical High School (CCRTHS) held the groundbreaking for their new building. Councilor Jessica Rapp Grassetti said that the ceremony recognized the Town of Barnstable’s long time representative Ann Williams who passed away in December. Council President James Crocker said that earlier in December he was joined by Town Manager Mark Ells, Barnstable CCRTHS representative Len Gobeil and others presented Ann with a proclamation recognizing her long service to the Town of Barnstable.

 OLD BUSINESS began with Planning and Development Director Elizabeth Jenkins and Attorney for Simon Properties Michael Ford presenting Agenda Item 2019-064 to Amend Zoning Ordinance, Article III. District Regulations, § 240-39(k) signs in the Shopping Center Redevelopment Overlay District (SCROD) which was approved.  Community Preservation Committee Chair Lindsey Counsell was joined by Barnstable Land Trust’s Janet Milkman to present Agenda Item 2019-065 Appropriation and Transfer order in the amount of $38,000.00 Community Preservation Funds for acquisition of conservation restriction 5.92 acres±, 0 Bumps River Road, Marstons Mills,  MA Map 168 Parcel 009 which was approved. DPW Dan Santos presented Agenda Item 2019-070 Resolve acceptance of easement 307 Falmouth Road (Route 28) Hyannis, MA which was approved.  Finance Director Mark Milne presented the next three items which were all approved:  Agenda Item 2019-072 Order to create a Water Stabilization Fund for the purpose of making comprehensive improvements to the Town’s drinking water and Fire Readiness Services; Agenda Item 2019-073 Order to accept the 4th paragraph of MGL Chapter 40 §5b allowing for the dedication of certain revenue streams to stabilization funds without further appropriation; and Agenda Item 2019-074 Order to dedicate future host community agreement payments from Vineyard Wind to the Water Stabilization Fund. NEW BUSINESS began with Agenda Item 2019-076 Resolve to authorize the Town Council President to delegate the responsibility to serve as an Ex-Officio member of all Town Council committees to the Vice President in the absence of the President which was approved. Planning and Development Director Elizabeth Jenkins presented the next three items which were all approved: Agenda Item 2019-077 Acceptance of Fiscal Year 2019 Mass Wildlife Habitat Management grant in the amount of $11,820 from the Commonwealth of Massachusetts for the West Barnstable Conservation Area; Agenda Item 2019-078 Acceptance of Fiscal Year 2019 Planning Assistance grant from the Commonwealth of Massachusetts in the amount of $50,000 to revise zoning and regulatory requirements for increased housing production in downtown Hyannis; and Agenda Item 2019-079 Transfer Order of $50,000 Fund to fund a qualified consultant to facilitate public outreach and to revise and draft regulations pertaining to short-term rental of dwelling units. A first reading of Agenda Item 2019-080 Authorization for the Airport Commission to enter into a Forty-Nine year lease for the property identified as Map 311, Parcel 092 and addressed as 790 Iyannough Road/Route 132, Hyannis, MA  was presented by Airport Manager Katie Servis. DPW Director Dan Santos presented Agenda Item 2019-081 Transfer Order of $45,000 from the Town Council Reserve Fund for the Replacement of the Heating/Cooling/Ventilation HVAC System at Hyannis Golf Course Clubhouse which was approved.  Town Manager Mark Ells and Barnstable Police Chief Matthew Sonnabend presented Agenda Item 2019-082 Acceptance of a Fiscal Year 2019 Legislative Earmark grant in the amount of $45,000 from the Massachusetts Department of Mental Health for the purpose of funding Homeless Outreach Sheltering Services in the event of severe cold temperatures which was approved.  Mr. Ells thanked Senator Julian Cyr for his assistance in securing this funding.  Agenda Item 2019-084 Appointments to a Board/Committee/Commission was bifurcated at the request of Appointments Committee Chair Jessica Rapp Grassetti.  The Zoning Board of Appeals appointment received a first reading.  Due to quorum issues for the Hyannis Main Street Waterfront Historic District Commission, the appointment was voted on and approved.  Agenda Item 2019-085 Reappointments to a Board/Committee/Commission: Steamship Authority received a first reading.  The next Town Council Meeting will be held on Thursday, February 7, 2019 at 7:00 PM in the Hearing Room of Barnstable Town Hall, 367 Main Street, Hyannis.

The event is from 7:00 to 8:30 PM. This is for Grades 6 & 7 Only.  Rock Night is an upscale Public Skate with a DJ, games and give-a-ways. Fee is $5 and if you don’t have skates, we have all brand new ones that can be rented for $5.    

 

Community Resiliency by Design Survey – Deadline for Responses January 30, 2019

The Community by Design project is a joint initiative to develop compact model housing designs that are appropriate for the distinct characteristics of the neighborhood while also serving the housing needs of the community.  The design team of Union Studios will be gathering community input on preferences for building forms, scale, height and styles at this workshop which will guide development of local implementation tools. Please take the survey to share your thoughts on creating housing solutions the community needs and supports.

 

Update on Wastewater Management Efforts in Barnstable

At the last Town Council meeting, DPW Director Dan Santos presented an Update on Wastewater Management Efforts in Barnstable.  Mr. Santos was joined by Assistant DPW Director Rob Steen, Interim Town Engineer Amanda Ruggiero, and Interim Assistant Town Engineer Griffin Beaudoin who have been working on the planning internally.  We thought we would share this important information again in this week’s eNews.  Mr. Santos’ presentation can be viewed here.

 

Please Return Your Town Census

The Town of Barnstable mailed out the Census/Voter/Street Listing forms.  By responding to the census, you are providing proof of your residency to protect your voting rights.  If all the information on your census is correct, simply sign the bottom of the census and send it back to the Town Clerk’s office.  Even if there are no changes you need to sign the form and send it back.  Also, if someone has moved out of your household and is a voter – please give us their address, email or phone number so that we may contact them to obtain verification.  We cannot remove a voter without their verification; thus many people stay on the census for four (4) years until we can, by law, remove them.  If anyone has been added to your household, just put their information down on one of the blank lines.  Make any and all corrections on the form.  You cannot register to vote on the census form.  If you have computer access you can go directly to the Secretary of State’s website and register on line at www.sec.state.ma.us.  Then click on “Elections and Voting” to register to vote; or come in to the Town Clerk’s office and spend a few minutes with us as we enter your voter registration into our computer.  We are always pleased to see and work with our residents.  For those residents who live part of the time here in Barnstable, and part of the time in a warmer climate, you fill out the census form using the following guidelines: 

ü  You are a Town of Barnstable resident if:

o   This is your permanent address

o   This is where are you registered to vote

o   On your Massachusetts driver’s license you have a Town of Barnstable address

The "Art on Loan" program displays the works of local artists on meeting room walls in Barnstable Town Hall.  Works created by Barnstable High School students will be on display in the Town Hall Hearing Room and Selectmen’s Conference in Barnstable Town Hall, 367 Main Street, Hyannis, 2nd floor, January 9th through February 28th, 2019. The work, process and interviews from the Sandy Neck Beach house experience will be featured in a mini-documentary created by the Town of Barnstable’s Chris Ledda, Video Specialist and Stone Dow, Video Assistant, airing on Barnstable’s Channel 18. ABOUT THE EXHIBITS

TOWN HALL HEARING ROOM:

This past fall four students from Barnstable High School’s Fine Arts 4 class participated in a field trip out to the Sandy Neck House at the “Halfway Point,” so called because of its location half way down the inner rim of Sandy Neck. The building, more of a nature camp than a “house,” is nestled in the maritime forest perched above the Barnstable Great Marsh. It overlooks a thick matted patch of marsh grass, Osprey nesting sites and a cluster of bird houses opening up to a view of Barnstable Harbor.  Students Anthony Almas, Maria Grigio, Bijon Luczkow and Grace Sanford, were tasked with combining what they had previously researched regarding the ecology, history, topography, and conservation aspects of Sandy Neck with their experiences journeying out to the halfway point. Accompanying them were Town of Barnstable Sandy Neck Naturalist Andrea Higgins, and Barnstable High School art teachers Abby Fay-Smith and Matt Kemp. During the day the students observed baby diamondback terrapins saved by the town’s conservation efforts, multiple tracks from a range of Sandy Neck fauna, explored the trails snaking through the maritime forest, gathered materials, and created a series of plein air sketches.  The group created a range of artistic responses, utilizing a variety of techniques including photo collage, mixed media painting, traditional acrylic painting, printmaking, and sculpture. They tell the story of the interaction of two of Barnstable’s greatest resources - the natural beauty of Sandy Neck and the bright, talented, and inspiring students of Barnstable High School.
SELECTMEN’S CONFERENCE ROOM:

Filipe Miguel’s, Fine Arts 2 at Barnstable High School, students are encouraged to express themselves through a series of works called the “Individual Concentration” In this assignment, they are asked to develop three or more artworks over the course of the school year, that have a personal connection or interest. Students are asked to create these pieces for homework or between projects, in addition to regular classwork that often focuses more on skill building, technique and art applications. The works in this exhibition are examples of their individual concentrations. They are often more expressive and engaging than the average assignment. Each piece is unique to the artist. Students exercise their creative thinking skills and demonstrate an ability to communicate a cohesive idea. The goal is to offer students an opportunity to develop their own personal voice in art.

Most of the times I go to Sandy Neck it’s either for work or to just enjoy myself at the beach, I’ve never truly focused on the background of the beach I know so well. This time I was given the opportunity to admire the nature around me with a guide to teach me about it and point out the small details I wouldn’t have noticed on my own. Never before have I gone to Sandy Neck with the intention of creating art from what I observe and I think it’s changing that lens through which I look that made this experience so strikingly different from the previous times before. It was relaxing and allowed me to take a break from the fast pace of life. When I was sitting outside the midway house and reflecting on everything I had seen and the view before me, I couldn’t help but feel overwhelmed. I realized that I’ve never just sat in nature and admired it for what it is. The colors and the textures of each plant all combined together made me feel an inner peace that I believe people rarely experience and I wish more people could. Yet, I couldn’t forget the trash that sat in the woods behind me and the man-made signs that contrasted the nature all around me. I was overwhelmed by all the colors and textures in the nature around me. I wanted to create something that accurately portrayed the beauty. I was inspired by the small plants I saw such as sea pickles and cranberries and goldenrod and even the poison ivy. I wanted to focus on incorporating the colors I saw while also drawing attention to the issue of pollution and the need to keep Sandy Neck intact for future generations. The texture of the marsh grass draws the eye and hopefully creates movement within the painting which reflects the never-ending movement and growth in nature. The black paint and roofing patch signifies the pollution that we see spreading more and more in nature. Just as the black paint ruins the beautiful picture, pollution ruins nature and its beauty. The multiple different shades of color were meant to incorporate all the colors and I saw while demonstrating that there are many different layers to nature and it is not just one simple color. I used acrylic paint to achieve multiple colors and shades that wouldn’t completely blend with each other as oil paint might have. The black paint and roofing patch is probably the most significant part of the piece as it draws the eye and forces the onlooker to think instead of just admire. Its thick texture was why I chose it because it is not merely mixing with the other colors but standing out on its own and covering the other paint.

Town of Barnstable Launches OpenCounter Zoning Portal
The Barnstable Zoning Portal, provided by OpenCounter, is an interactive, web-based mapping tool designed to make local zoning and other regulations accessible to the public. Barnstable Zoning Portal shows lot-by-lot land use details, including all overlay districts, to help applicants to understand what uses are allowed where.  The Barnstable Zoning Portal helps businesses understand how the Town’s Zoning Ordinance will impact site selection and project requirements. This tool is for research purposes only, and those interested in a property or opening a business should consult with the Town of Barnstable staff early in the planning process.

We strive to provide accurate results with this new tool, but there is no substitute for talking with one of Barnstable’s knowledgeable planners, who are available to answer all questions related to starting a business in our community.  Any results you receive from the Zoning Portal should be checked with a Town Planner prior to taking any action on a property.

5-Year Financial Forecast
A copy of the 5 Year Financial Forecast is now available on the Town’s website for public viewing. This report is submitted annually to town council and the public. The purpose of this financial forecast is to identify factors that may impact the financial condition of the Town such as, revenue and expenditure trends and any long- or short-term actions that may be taken into account.

ROAD WORK UPDATES
As always please slow down and use extreme caution when traveling through the road construction areas and follow posted safety signs.

*NEW* Road Work on Route 149, Main Street, and River Road in Marstons Mills
Construction is scheduled to begin the week of January 21. Initial activities scheduled through the end of January include survey staking/marking for construction, installing construction signage, installing tree protection, installing erosion controls, removing some trees where necessary, other selective clearing, and other associated work. During active construction in the roadway there will be lane closures with police details to direct traffic. Traffic may be delayed during lane closures and shoulder work, and motorists are advised to seek alternate routes to avoid the construction area.pan>

*NE*NEW* SEWER WORK – ATTUCKS LANE / PHINNEY’S LANE, HYANNIS
Sewer work at the intersection of Attucks Lane and Phinney’s Lane associated with the future Cape Cod Five Headquarters began on Thursday, January 10thup> and is anticipated to continue through Friday, February 1 as weather allows.  The anticipated work schedule is as follows:

               Work from Tuesday, January 22nd to Friday, February 1st will be completed during daytime hours and          will consist of gravity sewer installation within the shoulder of Attuck’s Lane.

               Work from Monday, January 28th to Friday, February 1st will be completed at night between 7:00 PM            and 5:00 AM and will consist of gravity sewer installation within the intersection of Phinney’s Lane    and Attuck’s Lane.

               Paving work is anticipated on Friday’s between 9:00 AM and 1:00 PM.

During active construction in the roadway there will be lane closures with police details to direct traffic.  Motorists are advised to seek alternate routes if possible to avoid construction work.  
*NEW* National Grid Upgrading Natural Gas Mains
21-369 South Main Street, Centerville.   The work will include marking underground utilities, excavating utility trenches, installing new gas mains, backfilling the trenches and repaving.  As part of this project, National Grid will also replace the natural gas service piping that connects the main to the customer’s gas meters. Construction is expected to occur within the dates listed above, weather permitting. National Grid has committed to complete this project promptly and with minimal disruption to the community. Visit

National Grid will distribute written notifications to all affected constituents. Operations will start promptly at 7:00 AM and run until 4:30 PM Monday through Friday.
*CONTINUES* MassDOT District 5 – Roadway Work Notification
MassDOT District 5 will be performing vegetation, tree trimming and removal of hazardous tree operations in the median adjacent to the Route 6 westbound high speed lane between Exits 6 and 4 beginning on Monday, January 14th, 2019. The work is anticipated to continue for approximately 15 days, and will be performed between the hours of 9:00 AM to 3:00 PM Mondays through Friday. The roadway will be limited to one lane of travel to accommodate larger pieces of equipment needed for the work. Lane takings on Route 6 will be done in accordance with pre-approved traffic management plans. PLEASE NOTE ***Drivers who are traveling through the affected areas should expect delays, reduce speed, and use caution. All scheduled work is weather dependent and/or may be impacted due to an emergency situation.> *UPDATED* Road Work on Sea Street in Hyannis
Construction activities from January 18th through January 26th are scheduled to include installation of drainage systems in and along Sea Street between Maple Avenue and Crescent Drive; construction of a shared use path (wide sidewalk) along the east side of Sea Street including removing some trees, shrubs, and fences where necessary, excavation, and placing gravel base; survey staking/marking for construction; and associated work. In addition to weekdays, construction will also occur on Saturdays unless prohibited due to holidays or community events. During active construction in the roadway there will be lane closures with police details to direct traffic. Traffic may be delayed during lane closures and shoulder work, and motorists are advised to seek alternate routes to avoid the construction area.
*CO*CONTINUES* SNEP Grant Stormwater – Prince Avenue (next to Prince Cove Marina) in Marstons Mills  
Stormwater work continues in the sand filter area and the sediment forebay towards the parking lot. The work is expected to continue as weather permits and to be completed with plantings in the spring. Traffic may be delayed during shoulder work. PLEASE NOTE ***Drivers who are traveling through the affected areas should expect delays, reduce speed, and use caution.
*CONTINUES* SNEP Grant Stormwater - Cordwood Landing, Cotuit
Remaining work includes paving the area around the board drips which is expected to continue as weather permits. The plantings will be completed in the spring.  Area remains open to foot passage, except during paving. Once paving is completed the area will open to vehicles.
*CONTINUES* Route 28 (Falmouth Road) at Bearse’s Way 
The Massachusetts Department of Transportation (MassDOT) will continue their roadway improvements for the “Route 28 Intersection Improvements at Bearse’s Way.” The project includes traffic signal and pedestrian improvements, constructing retaining walls and medians, and road widening.  Traffic during construction operations will be delayed and motorists are advised to seek alternate routes to avoid the construction work.  Specific traffic detours will be communicated as the work progresses and as updated information becomes available. The work hours will be 7:00 AM to 5:00 PM, Monday through Friday.
*UPDATED* Overhead Utility Line Relocations along Route 149 and Main Street in Marstons Mills
Verizon has installed new utility poles in some locations along Route 149 between Route 28 and Lovell’s Lane, as well as on Main Street between Route 149 and the former elementary school. Eversource and Verizon will be relocating their overhead lines to the new poles, and when that is completed they will remove the old poles. This work is in conjunction with the Town project to improve these sections of roadway. The overhead utility relocations are not expected to interfere with traffic, although temporary lane closures with police details might be necessary in some locations.

StoStorm Damage Repair Project at Blish Point, Barnstable

The Department of Public Works is repairing storm-related erosion damage at Blish Point in Barnstable began on Wednesday, January 16, 2019. The focus of the repair work is to replace sand along the dune area northwest of the Millway Beach parking area. Materials and equipment will be staged temporarily in the parking lot for the Blish Point boat ramp while the work is ongoing. The project is expected to be completed by Friday, February 1, 2019, weather permitting.  Vehicle access to the Blish Point boat ramp and parking lot will be maintained during the construction operations; however, a portion of the parking lot will be sectioned off for delivery and offloading of replacement sand, staging of materials and operation of equipment.  Users of the boat ramp are advised to use extreme caution while using the facilities. Operations will start promptly at 7:00 AM and run until 5:00 PM.   As always, please slow down and use extreme caution when traveling through the road construction areas and follow posted safety signs.

The Town of Barnstable has over 40 boards, committees, and commissions with approximately 291 seats. Our citizen participation is exemplary and the Town Council appreciates each and every member who serves.
